GENERAL TERMS & CONDITIONS OF SALE

Note:

Sale of any products or services is expressly conditioned on Buyer’s assent to these Terms and Conditions. Any acceptance of the seller’s offer is expressly limited to acceptance of these terms and conditions and the seller expressly objects to any additional or different terms proposed by the Buyer. No Buyer form shall modify these Terms and Conditions. Any order either written, verbal, or by monetary deposit to purchase services or products from Buyer shall constitute Buyer’s assent to these Terms and Conditions.

Estimates:

Our estimates will be prepared on the discussions between yourself and Shauna Kelly Interiors and is valid for 3 months from the date of issue.

Payment:

No account is directly offered by the Company. All projects undertaken by the company are subject to a staged payment method. Our company policy is upon agreeing to undertake the project an initial 25% down payment against an indicative budget is completed by the client. This down payment allows the company to allocate design and management time to undertake the initial scope of works and original designs. A second 25% payment is payable when designs are agreed and approved. Further payments are completed throughout the ordering and manufacture stage of the project with all monies outstanding payable before delivery and completion of the project. Any other terms agreed will be at the discretion of the Company. Any sum outstanding after collection/delivery, inclusive of VAT shall be regarded as overdue and will attract interest payable to the Company at 5% above the national bank base rate, accruing daily until such time that full payment has been received. If the customer fails to pay for the goods ordered and the goods are delivered, the Company shall have the right to repossess all goods supplied by the Company at any time.

Designs:

Due to the nature of the Interior Design Business, we cannot guarantee that clients will always like our recommendations. Interior Design can be subjective. Unfortunately, we cannot provide any refunds if this is the case. However, please do feel free to contact us and we will be happy to discuss the design concepts further over and perhaps make further recommendations.

Social Media:

Due to the nature of our business and the high visual aspect of our design creations, we commonly promote our work across multiple social media channels. These images usually take the form of but not limited to Photos, Videos both across multiple locations including in-house design creations, construction, installation and finished client designs. Clients can request to ‘Opt Out’ by way of a written request at engagement stage.

Title of Goods:

Title of Goods shall not pass to the Customer until the Supplier has been paid in full for the Goods.The Supplier shall have no liability in the respect of any delay to the completion of any project.

Cancellations:

Cancellations may only be affected at the Customers written request and the company’s subsequent approval.

Returns:

Goods returned from our home accessories department within a period of 14 days will be exchanged for a credit note subject to goods being resalable condition. Shauna Kelly Interiors will assist in determining quantities of goods required by Customer; however, it is the responsibility of the customer to check this with their sub-contractors as surplus materials may not be returned for credit.

Defective Goods:

In the event of any item bring defective in material or workmanship, we will require all claims to be made within 7 days of the said goods. All goods that are claimed to be defective the Company at their discretion will either repair or replace. The Customer must allow access to the Supplier or their sub-contractors to repair any goods that are found faulty. The Company is not liable for any defects due to wear and tear, improper use, misuse, or neglect. We do not accept liability for consequential loss or damage, and liability for any such consequential loss or damage is excluded.

Specification and Colour:

We have taken every measure to provide representative images and sample materials for our services. However, we cannot be held responsible or liable for any differences in colour between image and or sample and the actual product.

Fading:

All fabrics are susceptible to fading if exposed to strong or natural sunlight for prolonged periods. Silk by nature is particularly susceptible and will fade if exposed to strong direct natural or artificial light for prolonged periods. We are unable to accept liability for fading. We would also draw your attention to the fact that were fabrics are subject to variations in atmospheric conditions, shrinkage and/ or dropping may occur in the situ for which cannot be held responsible.
